Please be sure you read these new Terms and Conditions and all other policies to make sure you understand all changes that may be important to you. Disputes about these Terms and the Services, services, and websites provided by Dom The Hypnotist LLC are subject to binding arbitration and a waiver of class action rights detailed in Section 10 below. PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION CLAUSE. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION CLAUSE, YOU AND Dom The Hypnotist LLC AGREE THAT DISPUTES RELATING TO THIS TERMS OR YOUR USE OF OUR SERVICES AND SERVICES WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION
We want to thank you for using Dom The Hypnotist LLC! Dom The Hypnotist LLC offers our customers services, content and digital tools and community to work on their personal development—in other words, your growth is our mission. Dom The Hypnotist LLC provides value through our coaching services and personal growth content and tools through websites, apps, livecasts, social media, members areas, community sites, and digital tools and the entire selection of services and tools offered to our audience on are our “Services”. Dom The Hypnotist LLC is a brand owned and operated by Dom The Hypnotist LLC based in Nevada. This Terms of Services Agreement (this “Agreement”) contains the terms under which Dom The Hypnotist LLC provides our Services to you and describes how the Services may be accessed and used. You must read, agree, and accept all terms and conditions contained in this Agreement and expressly referenced in this Agreement, including our PRIVACY POLICY, before you subscribe for our Services. If you will be using the Services on behalf of an entity or other organization, you agree to these Terms on behalf of that entity or organization and you represent that you have such authority. “You” and “your” will refer to that entity or organization. When you subscribe to our Services, or otherwise use or access the Services, you agree to be bound by these Terms and applicable laws, rules, and regulations. You may be asked to click “I accept” at the appropriate place prior to your purchase of or access to our Services. At such time, if you do not click “I accept”, you may not be able to complete your purchase or access our Services. If you do not agree to these Terms, please do not use our Services in any way. Dom The Hypnotist LLC is not an accredited educational institution or marketplace or SAAS company. Our users, customers, teachers, and partners are not our employees. We are not responsible for any interactions between you and our customers, students, subscribers, teachers or users (collectively, “End-Users”), other than providing the Services for you to interact with our company. We are in no way liable for any disputes, claims, losses, injuries, or damage of any kind that may arise out of your relationship with End-Users, including any End-Users reliance upon any information or content that you provide or post on our platform.
All payments for services are non-refundable unless explicitly stated at the time of purchase or as required by law. Refunds will only be provided under the following circumstances:
• If a customer cancels a subscription within the first 3 days of their initial purchase, they may request a full refund.
• If Dom The Hypnotist LLC materially breaches these Terms and does not resolve the issue within 30 days of written notice from the customer.
• If a refund is legally mandated based on the customer's jurisdiction.
No refunds will be provided for unused portions of a subscription once a billing cycle has begun, except where required by law.
Monthly payments for 1 on 1 sessions with a hypnotherapist and or $197 monthly payment plan for the Money Magnetism webinar program do not qualify and are agreed to be paid in full.
$44, $78 and $98 monthly subscriptions for extended access to weekly group calls renew automatically at the end of each billing cycle. To prevent charges for the next cycle, customers must cancel at least 72 hours before the renewal date. Cancellation can be done only by contacting support at support@domthehypnotist.com. If cancellation is requested after renewal, the subscription will remain active until the end of the billing cycle, and no refund will be issued for the unused portion.
You retain full ownership of your content. However, by uploading content through our Services, you grant Dom The Hypnotist LLC a limited, revocable, non-exclusive right to use and display your content solely for the purpose of providing the Services. If you delete your account, this license will automatically terminate, except for backup copies retained as part of normal business operations.
Our support team can assist with account access, billing, and general service usage but does not provide psychological, medical, or therapeutic advice. Customers seeking professional support should consult a qualified expert. Dom The Hypnotist LLC is not responsible for interactions between users or any reliance on information provided by other users.
Dom The Hypnotist LLC complies with applicable data protection laws, including GDPR, where required. Personal data will be retained for the duration of your account and for up to one year after account deletion unless legal obligations require otherwise.
By providing your phone number, you consent to receive SMS updates. You may opt-out at any time by replying “OUT” to any message. If you continue to receive messages after opting out, please contact support@domthehypnotist.com, and we will resolve the issue within 7 business days.
Dom The Hypnotist LLC reserves the right to update these Terms. Any material changes will be communicated via email or upon account login at least 30 days before taking effect. If you disagree with the revised Terms, you may cancel your account before the changes take effect.
9. Intellectual Property Notice
All content, designs, trademarks, and other intellectual property associated with our digital and physical products are the exclusive property of Dom The Hypnotist LLC, Dominique Bertoncini, or our licensors. Unauthorized use, reproduction, or distribution of any of our intellectual property, including but not limited to the Money Magnetism Program, recordings, live events, weekly group calls, materials shared via email or text, and our free live hypnosis session, is strictly prohibited without prior written consent.
10. Agreement to Arbitrate
By using our online services, you agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of our online services or in person services shall be resolved through binding arbitration, rather than in court. This applies to all claims, whether arising under contract, tort, statute, or any other legal theory.
Waiver of Class Actions
You agree that any arbitration will be conducted on an individual basis, and not as a class action or representative action. You waive any right to participate in any class or representative action in any forum.
11. Disclaimers
The assigned hypnotherapist is not a licensed physician and cannot prescribe medication, diagnose medical conditions, or treat mental disorders. Hypnotherapy is considered an alternative or complementary treatment and is not a substitute for medical or psychological care provided by licensed professionals. The services provided by Dom The Hypnotist LLC are not licensed by any government authority.
Additionally, if a client has a ticket to a live/virtual event and does not attend, they are not entitled to a refund. If an event is canceled due to uncontrollable circumstances (e.g., natural disasters, venue issues, or government restrictions), the client ticket will be applied to a future virtual event instead.
